Terms of Service

These Terms of Service ("Terms") govern your use of HashedByte Hosting LLC ("HashedByte," "we," "us") services, including hashedbyte.com, member.hashedbyte.com, and any servers, storage, or software we provide.

1. The Services

We provide hosting and managed technology services as described on our website and in your order. Services are provided on a month-to-month basis unless otherwise agreed in writing.

2. Accounts & Orders

• You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
• Orders placed through the member portal are requests; they are accepted when we confirm and begin provisioning. Custom quotes are valid for 30 days.
• We may decline or cancel any order, including for suspected fraud or prohibited use.

3. Payments & Invoicing

• Plans are billed in advance on the schedule stated on your invoice (monthly or annual).
• Late payments may result in suspension of service after notice. Terminated accounts are subject to data deletion after the retention period.
• Discounts (annual, nonprofit, educational, creator) are applied at checkout/invoicing and require eligibility verification.

4. Acceptable Use

You agree not to use our services to: violate law or third-party rights; send spam or malware; attack other networks or systems; operate services that disrupt our infrastructure or other customers; or host content we determine, in good faith, to be unlawful. We may suspend services for violations while we investigate.

5. Uptime & Backups

• We aim for high availability but do not guarantee uninterrupted service. Our Service Level terms are defined in your contract.
• Backups are offered as a feature. Where provided, they are made available for recovery of your own data; you remain responsible for maintaining your own copies of critical data.

6. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim relating to the services is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.

7. Termination

Either party may terminate services on written notice as described in your order. We may terminate for breach with 48 hours' notice. Upon termination, you must download your data before the deletion date stated in the termination notice.

8. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Disputes shall be brought in the state or federal courts located in Erie County, New York.

9. Changes

We may update these Terms; material changes will be announced on this page with a new "last updated" date. Continued use of the services after changes means you accept them.
